1. Scope

The following Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in exercise of their commercial, business, or profession.

The presentation of the products in our online shop is not a legally binding offer, but a non-binding online catalog. You may place one or more items in your shopping cart without obligation and amend your entries at any time before submitting your final binding order by using the correction tools provided and explained during the ordering process. By clicking the order button, you make a binding offer to purchase the goods contained in your shopping cart. Confirmation of receipt of your order is sent by email immediately after the order has been filled.

We ensure that your offer will be binding by either:

  • sending a confirmation of our order in a separate email, or
  • fulfilling the payment and delivery. The contract is concluded at the point in time our payment transaction is confirmed or the payment method selected (see "Payment").

The applicable contract is the one concluded online.

3. Contract Language, Storage of Contract Text

  • The language(s) given group(s) is/are available for concluding the contract: German, English.
  • We store the contract text and send you the order data as well as these Terms and Conditions in text form.

4. Delivery Conditions

  • We do not deliver to shipping addresses of consumers. An international store address is not used in the shipping process. Any application to have your order shipped by air is manually given.
  • We add to our listed fee the additional costs of delivery, the amount of which may vary which must be paid by the customer.
  • We do not carry out delivery to shipping that is commercially not possible.
  • The delivery time is as imposed, but is not valid for all items. Delivery times begin on the next working day after the customer issues the payment order to their bank (in the case of prepayment), or on the next working day after the contract has been concluded for all other payment methods.

  • If the shipping provider for the package is at fault and causes delivery to the customer to not be at risk, the customer must contact the delivery company.

The customer is at fault if:

  • The customer is not responsible for the delivery address information.
  • There is a reference to any delivery method to accept the delivery, after which the customer will notify them of the delivery after their first appearance.

5. Payment

The following payment methods are generally available in our shop.

Payment in advance

If you choose the payment in advance, we will provide our bank details in a separate email. Using the checkout process, you will enter your credit card information, your bank will be charged immediately after the order has been submitted.

PayPal, PayPal Express

To pay the invoice, you must be registered with PayPal, authenticate with your login data and confirm the payment. Further, the payment transaction on the background of your administration is done during the order. Additional information is provided during the ordering process.

PayPal may offer additional payment acceptance options, subject to customers’ needs, on its own criteria. We have no influence on any further methods; they may be added to your account status along with this.

PayPal

In cooperation with the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), we offer the following payment options as PayPal Services. About common payment services, we inform you as to the support of payment and in our consultation that the payment transaction is only possible through the PayPal account.

  • Pay by Invoice: For payments where the PayPal account is used, you must be registered with PayPal and authenticate yourself with your login data.
  • Credit Card via PayPal: Your card will be charged by PayPal after the order has been shipped.
  • Direct Debit via PayPal: Your bank account will be charged by PayPal after the order has been shipped.
  • Purchase on Account via PayPal: These invoices are sent via email addresses directly via PayPal.

Sofort by Klarna

To pay the invoice amount via the payment service provider Sofort GmbH, you must have an online banking account with a bank that has been activated for participation in Sofort. During the order process, you will be redirected to the payment site of Sofort GmbH and you will confirm the payment. After that, the order will be processed. Further information is provided during the checkout process.

Apple Pay

Mastercard

Mastercard may handle the bank data for payment purposes and will be the one that handles the card data. In case of Mastercard, all data will be handled for the transaction to Mastercard, and Mastercard may inform us about the transaction details. VISA

The provider of this payment method is Visa Europe Services Inc., London branch, 1 Sheldon Square, London W2 6TT, United Kingdom ("Visa").

The data will be processed when handling the transaction with all data protection standards in the country of origin and the European Union. Visa may inform us about the transaction details. 6. Retention of Title

The goods remain our property until payment has been made.

7. Right of Withdrawal

Consumers have the statutory right of withdrawal in 14 days. The details can be found in the individual policy.

8. Transport Damage

For goods delivered with obvious transport damage, please report such faults as soon as possible and contact us. There is no legal obligation to report immediately, but failing to do so may affect your ability to claim under the warranty or insurance.

9. Warranty and Maintenance

Statutory warranty rights apply (Age of warranty: 2 years).

10. Guarantees

11. Liability

For claims arising from damages caused by us, our legal representatives, or agents, we are liable under all limitation.

  • in the case of injury to life, body or health,
  • in the case of intentional or grossly negligent breach of duty,
  • in the case of guarantee commitments, as agreed, or
  • insofar as the scope of the Product Liability Act applies.

In the event of a breach of essential contractual obligations, the fulfillment of which is necessary for proper performance of the contract and which the contractual partner may regularly rely on, our liability is limited to foreseeable damage, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

12. Data Protection

The handling of personal data is governed by our Privacy Policy.

13. Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR), which can be found at https://consumer-redress.ec.europa.eu/site-relocation_en. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.

14. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection regulations of the country in which the consumer resides remain unaffected.
